1. Acceptance of Terms
By accessing, browsing, or using the Xamip™ platform, website, or mobile applications, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please refrain from using our services.
2. Description of Service
Xamip™ is being built as a hyperlocal offer discovery platform designed to connect consumers with nearby shop discounts and help local retailers gain digital visibility. The platform is currently in pre-launch. All features described are indicative of intended functionality and are subject to change.
3. User Eligibility
The use of Xamip™ is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 — including minors and un-discharged insolvents — are not eligible to use the platform.
4. User Responsibilities
Users are responsible for maintaining the confidentiality of their account credentials. You agree to provide accurate, current, and complete information during the registration process and to keep such information up to date.
5. Shop Owner Responsibilities
Shop owners registered on Xamip™ are solely responsible for the quality, safety, and legality of the items advertised, the accuracy of the listings, and the fulfillment of orders. Shop owners must comply with all applicable local tax and trade regulations.
6. Intellectual Property Rights
STRICT NOTICE: All design, structure, user interface (UI), underlying code, algorithms, and conceptual frameworks of the platform belong exclusively to Xamip™ Technology Labs.
The platform is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999 of India. Any unauthorized reproduction, redistribution, modification, or reverse engineering of the Xamip™ software or interface is strictly prohibited and will lead to civil and criminal legal action.
7. Platform Evolution
We are constantly working to improve the platform. You acknowledge and agree that the form and nature of the services which Xamip™ provides may change from time to time without prior notice to you.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Xamip™ Technology Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
9. Indemnification
You agree to indemnify, defend, and hold harmless Xamip™ Technology Labs and its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the platform or your violation of these Terms.
10. Termination
Xamip™ Technology Labs reserves the right to suspend or terminate your access to the platform at any time, with or without cause, and with or without notice, including for violations of these Terms or conduct that we determine to be harmful to other users or the platform.
11. Governing Law & Jurisdiction
These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Karnataka.
12. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
13. Amendments
Xamip™ Technology Labs reserves the right to modify these Terms at any time. We will indicate the revised date at the top of this page. Your continued use of the platform following any changes constitutes your acceptance of the updated Terms.
